Pre-nuptial agreements are not automatically enforceable in courts in England and Wales. The fairness of upholding any agreement is considered on a case by case basis, which means a pre-nuptial agreement is not seen as a binding contract.

Post-Nuptial Agreements
Like a pre-nuptial agreement, a post-nuptial agreement is an agreement that outlines how assets, debts, financial matters and child living arrangements are handled should a marriage end in divorce.
The difference between a “pre-nup” and a “post-nup” is that a post-nuptial agreement is agreed once a couple has become married (rather than before the wedding).
Post-nuptial agreements are not currently legally binding in England and Wales.

Separation Agreements
