Dispute resolution can be a helpful tool for a wide range of disputes including those involving landlord and tenant agreements, trusts, contentious probate, and contractual matters.

There are many ways that legal issues can be handled, and it can become very expensive to take disputes through a Court of Law. Dispute resolution is often used as a quicker, simpler approach to reaching an appropriate outcome.

Our Assistant Solicitor, Rhiannon Moody works in our Litigation Department focusing on dispute resolutions. Here’s some important information she thinks you should know.

What is dispute resolution?

Dispute resolution deals with civil matters and is the process of settling conflicts and/or disagreements between parties. You can resolve these types of disputes by way of Alternative Dispute Resolution (ADR) such as Negotiation, Mediation and Arbitration or by Court proceedings. However, you should only consider Court proceedings as a last resort.

Dispute resolution is important as it helps to resolve issues in a fair and less conflicting manner. It’s dealt with by legal professionals who will act on your behalf to achieve the best possible outcome for you.  The main aim of ADR is to attempt to reach an early settlement of a claim without the need of the Court’s intervention.

Is my case suited to dispute resolution?

Dispute resolution works well for a wide range of potential claims experienced by both corporate clients and individuals. If you’re unsure about whether your claim would be better managed as a dispute resolution, it’s better to ask a legal advisor.

What are the benefits of dispute resolution?

ADR saves time and money that would typically be spent on Court proceedings. It also allows your solicitor to help alleviate some of the stress experienced by the client when dealing with a dispute. It’s a way of achieving a fair result which allows all parties to deal with matters as amicably as possible and walk away with hopefully a satisfactory resolution at the end.
